OvertonIQ is a media intelligence platform that analyzes how news outlets frame political stories. Our Service provides lean scoring, narrative tracking, omission detection, quote analysis, and related media analytics. The Service is currently in pre-launch and accessible via a waitlist and interactive dashboard preview.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account Registration
When our platform launches, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Scrape, crawl, or use automated means to access the Service without our written consent

- Misrepresent OvertonIQ data, scores, or analysis as official ratings or endorsements
- Use the Service to harass, defame, or intimidate any individual or organization
5. Intellectual Property
The Service, including its design, features, algorithms, scoring methodologies, and content created by OvertonIQ, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on our Service without express written permission.
News content analyzed by OvertonIQ remains the intellectual property of its respective publishers. OvertonIQ provides analysis and metadata about news content, not the content itself.
6. Data and Analytics Disclaimer
OvertonIQ's lean scores, framing analysis, and other metrics are generated through algorithmic analysis and are provided for informational purposes only. They represent our analytical assessment and should not be construed as absolute truth, official ratings, or endorsements of any political position.
We strive for accuracy and methodological rigor, but media analysis inherently involves interpretation. Users should exercise their own judgment when relying on our data for decision-making.
7. Pricing and Payment
When our paid service launches, pricing will be published on our website. We reserve the right to change pricing with 30 days' notice to existing subscribers. Free tier features may be modified or limited at our discretion.
8. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, OvertonIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

You agree to indemnify and hold harmless OvertonIQ and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Brevard County, Florida.

We may modify these Terms at any time by posting the revised version on our website. Material changes will be communicated via email to registered users. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
